Let's be real — real estate can get confusing fast.
If you don't know who’s officially in your corner, you could end up making big decisions without the backup you deserve. (And nobody’s got time for that.) Knowing how real estate agency works isn’t just “paperwork stuff” — it’s how you make sure your agent is legally and loyally fighting for your best deal. Let’s dive in and make sure understand your rights when working with a Realtor in Illinois.

What is a "Real Estate Agency"?
Think of agency like hiring an expert to represent you — similar to an attorney or stockbroker.
In real estate, an agent acts on your behalf to help you buy, sell, or lease a property.
By law, your agent owes you important duties that protect your best interests during the transaction.
How Representation Works: "Designated Agency" Explained
In Illinois, when you work with a real estate agent:
You are presumed to be represented by that specific agent (unless you agree otherwise in writing).
Other agents within the same company may represent the other side of your deal.
You'll also sign a brokerage agreement — it's official, but don’t worry — it just ensures that your assigned agent is committed to YOU!
Your Agent’s Duties to You
Your agent must:
Seek deals that match your needs
Present all offers to and from you
Disclose material facts they know (without breaking confidentiality)
Obey your lawful instructions
Keep your personal information private
Promote YOUR best interests above anyone else's
👉 Bottom Line: Your agent works for you, not for themselves or anyone else.
Customers vs Clients: What’s the Difference?
Clients (YOU, if you have an agreement) get full representation and loyalty.
Customers (those without a signed agreement) get basic information and help — but no fiduciary loyalty.
If you're a customer, be careful what you say, because the agent represents the other party, not you!
What About Dual Agency?
Sometimes, the same agent represents both sides (buyer and seller) — but only if both parties agree in writing.
In this case, the agent’s role becomes limited, meaning they can’t fully advocate for either side.
Good to know: You don’t have to agree to dual agency. It’s always your choice!
What Paperwork Should You Expect?
You should receive:
A written disclosure naming your designated agent
A brokerage agreement outlining the relationship
If dual agency applies: a separate disclosure and consent form
All of these documents can be provided electronically or on paper.
